19th Street

 

Stopping the proposed 19th Street between South Redmond and Deschutes Junction.

Seeking to save millions in taxpayer dollars as well as to prevent fragmentation of agricultural lands, LandWatch won at LUBA in 2010 against a Deschutes County decision to create a new parallel road to Highway 97 between Redmond and Bend.

LUBA in its decision in Central Oregon LandWatch v. Deschutes County, ____ Or LUBA ____ (LUBA No. 2010-042) (2010), LUBA ruled that the County Transportation System Plan failed to show an adequate need for the proposed road, that the County failed to adequately address alternatives, that the County failed to assess reasons justifying why the state policy to protect agricultural land should not be preserved, failed to address federal lands as part of its goal exception process, and failed to assess impacts on other roads.

This was a case of statewide significance on what constitutes a sufficient “need” for a “goal exception” to justify a new road (and eventually numerous additional land uses) on agricultural lands.
